The Privacy Amendment (Privacy Sector) Act 2000

How does it affect WineSale?

Privacy Policy:To assist in complying with the principles, WineSale is required to inform the customer of their rights in relation to the personal information held about them and its' use.

There are several ways that WineSale obtains and uses personal information:

- To assist the order process, we require certain personal information to accompany the receipt of purchase. The personal contact details supplied are stored in the WineSale database for the purpose of the purchase order security, ie. Record of purchase, proof of delivery, etc. and informing the customers of future offers and the renewal of subscriptions.

- An individual may join as a customer and be included in our mailing list just for the purpose of receiving notification of special offers. When a customer purchases an order for another individual, this information is also retained.

- If the customers’ personal information is currently on the WineSale database, WineSale will maintain these contact details on computer so that we can continue to provide the customers with wine related information.

Should the customers’ personal contact details be inaccurate, need updating, or they would like to be removed from the database, the customer is required to contact WineSale so that appropriate action can be taken. The customer can notify WineSale of their request by calling 02 9643 8627, or email admin@winesale.com.au

Collection of Personal Information

In accordance with the National Privacy Principles, personal information will only be collected by WineSale if:

  1. If it is necessary for one or more of it's functions such as taking an order.
  2. If it is collected lawfully and by fair means and not in an unreasonably intrusive manner.
  3. It is collected from the individual to whom the information relates (where personal information about an individual is collected from someone else, reasonable steps will be taken to ensure that the individual is made aware).

Disclosure of Personal Information: WineSale does not, unless required by law, disclose personal information it has collected to other organisations.

Failure to provide personal information: If requested information is not provided, WineSale may be unable to complete a transaction or it may impede our ability to provide a requested service.

Spam Act 2003 Compliance

New Email Broadcasting Laws

The Spam Act 2003 came into effect on the 10 th of April 2004 , throughout Australia . The Act refers to spam as “unsolicited commercial electronic messaging”.

The act requires that we get your explicit permission to send you our email specials and promotions. If you no longer wish to receive communication from us, please contact us by email, phone, fax or mail.

What is Spam?

Spam is unsolicited commercial electronic messaging. Electronic messaging covers emails, instant messages, SMS and other mobile phone messaging.

The Act

To comply with the Spam Act, the message must be commercial in nature, for instance, offering a commercial transaction, or directing the recipient to a location, where a commercial transaction can take place.

There are a large number of commercial email messages that can be sent legitimately, as the email is only considered to be Spam if it is sent without the prior consent of the recipient - as unsolicited messages.

Furthermore, single messages can also be deemed as Spam, as the Spam Act makes no reference to bulk messaging.

The three key steps you need to follow are:

1. Consent:

Only send commercial electronic messages with the addressee's consent - either express or inferred consent.

2. Identify

Include clear and accurate information about the person or business that is responsible for sending the commercial electronic message.

3.Unsubscribe

Ensure that a functional unsubscribe facility is included in all your commercial electronic messages. Deal with unsubscribe requests promptly.

Important Note: The WineSale email database is managed in accordance with Privacy Act 1988   (Privacy Amendment (Private Sector) Act 2000 and it's email marketing practices comply with the provisions of the Spam Act 2003 .

All email communications include a functional unsubscribe facility, including email and phone to allow the communication of the addressee's wishes to cease receiving correspondence from WineSale.

Any request to be removed from the WineSale email database will be acted on within 24 hours of receipt of that advice, whether that advice be by email or phone.

SECURITY

If you are nervous about shopping online, don't be. We use secure servers with state of the art encryption and secure socket layers (SSL) technology for the transfer of credit card information. Additionally, we have security measures in place to protect our customer database and access to this database is restricted internally.

Whilst all care is taken to protect your details, it is however, your responsibility to protect your password from being disclosed to any third party.
