Australian Liquor Act stipulates that it is an offence to
sell, supply or obtain liquor on behalf of a person under
the age of 18 years.
Prices and Payment
All
prices are quoted in Australian Dollars and may be per bottle/item
or per case, as marked. All prices include Goods and Services
Tax (GST). Unless specified, any delivery charges are additional.
We
accept payment by Diners, Visa, Mastercard, Amex and Bank
Card

Our
cartons can fit up to 18 standard bottles.
Our
carrier choice is Australia Post, voted Australia's number
1 delivery company in 2001. All wine orders can be delivered
to any nominated address in Australia, including Post Office
boxes as an option.
Australia Post will deliver Monday to Friday between the
hours of 9.00 am - 5.00 pm. Most of our customers give instructions
to leave the wine in a safe place as this is by far the
easiest way to ensure you get your wine on time. If the
person accepting the delivery is out and there are no delivery
instructions, Australia Post will leave a card in the post
box to collect at the local Post Office. Please note that
we cannot accept instructions to contact you as Australia
Post couriers cannot call before delivery.
The diagram below shows the standard Australia Post delivery times, listed in business ( working) days during non Christmas or holiday periods.
Please note that these are intended as a guide only, particularly with regards to isolated regional areas. We do not and cannot provide guarantees on delivery times under any circumstances, mainly due to the limitations of Australia Post. WineSale shall not be liable for any delay in delivering
your wine if that delay or failure is caused by circumstances
beyond our control such as war, riot, civil commotion, malicious
damage, compliance with any law or governmental order, rule,
regulation or direction, fire, flood, storm or act of God,
failure of Internet Service Provider (ISP) or telecommunications
provider in connection with the performance of the WineSale
website.
Please note that all delivery prices are subject to change
without notice.
Stolen
Wine and Breakages
If
you give us specific instructions to leave your wine, (we
prefer that if no-one is home the wine is then available
for collection from the local Post Office), and the wine
gets stolen, you are responsible. Under special circumstances
we will consider replacing the wine free of charge. If there
are any breakages, please notify us by calling or 02 9643

Returns
If
some or all of the bottles of wine in a case are broken,
corked, oxidised or not of merchantable quality when they
are delivered, please notify us as soon as possible. You
may choose either to return the whole case for a refund
or a replacement.
We will refund you as soon as the wine is picked up and
received back into our warehouse.
Any
wines collected by Australia Post must be in their original
box to avoid further breakages, where possible.
Quality
If
you purchase any wines from us and you're not happy with
it, we will credit your credit card for the amount of that
bottle. If you bought multiple bottles of a particular bottle,
then we will refund them as well, including freight, as
soon as we have collected the rest of the wine from you
and it is received back into our warehouse; provided that
you have only opened one bottle.
Availablility
Wine
is an agricultural product and runs out from time to time.
If you order a case of wine, we may substitute some of the
bottles by a different vintage or wine of equal quality
and value guaranteed. We don't use this as an opportunity
to advertise a good wine and supply inferior products. If
you ever have a cause to disagree with our choice of replacements
on any of the bottles that we have changed over, we will
give you a credit for the first bottle and will need to
collect any remaining bottles and credit you once they are
received back into our warehouse
Change of Details
You are responsible for notifying WineSale of any change
of name, address, payment details or other relevant details
by calling our customer care department on 02 9643 8627.
Alternatively, you may email us at
admin@winesale.com.au Failure to do so may result in
you being ultimately responsible for any misdirected items
(with regards to deliveries going to the wrong address).

as soon as possible. We try to resolve most issues immediately,
however, where this is not possible, we will keep you informed

you have any particular suggestions or feedback about how

Warranties
We
warrant that the wines will be of satisfactory quality and
fit for their general purpose.
Intelectual
Property Rights
You agree and acknowledge that we own or are licensed to
use all copyright, database rights trademarks and other
intellectual property rights in and to all parts of this
website.
You are entitled to use our web site in accordance with
these terms and conditions only. You must obtain our prior
written consent before you use our website or any part of
it in any other matter
All persons, individual and corporate, are prohibited from
providing hypertext or other links to the winesale.com.au
website, other than to our home page, from their own website
or from a third party's web site, without our prior written
consent.
Limitation of Liability
Nothing in these terms and conditions shall exclude WineSale
online's liability for personal injury or death caused by
its negligence.
Subject
to the above statement, WineSale will not be liable for
loss or damage caused by the customer handling the wine.
In particular, we will not be liable for spillages or breakages.
WineSale
will not be liable for any loss or damage caused by us or
our employees or agents in circumstances where:

loss or damage was not foreseeable to both parties when
the contract was formed;

loss or damage was not caused by any breach on the part
of the supplier;
-
loss or damage relates to business and/or non-consumers.
Customers
should also be aware of the following inherent risks and
warnings:

Alcohol should be consumed in moderation;

A case of wine is heavy so extra care should be taken
when lifting it. If you are concerned about the weight,
we advise that you transfer the bottles 1 or 2 at a time;

Red wine in particular may cause staining if spilt so
extra care should be taken;
-
Sparkling wines and Champagnes can be volatile due to
the build up of gasses so extra care should be taken when
opening these.
General
WineSale
may change or add to these terms and conditions for security,
legal or regulatory reasons. We will not use this right
to vary the terms of any special offer that applies to you.
The sale of goods takes place only when specific goods are
appropriated to the terms and conditions.
Relevant
Australian law will apply to these terms and conditions
and the relevant courts of Australia will have exclusive
jurisdiction.
